NIPSA wins historic first case

As the appointed NIPSA solicitors McCartan Turkington Breen were delighted to draft legal arguments for NIPSA members in a recent ground breaking case against Heath and Social Care Board (HSCB).

This was the first employment case to be tested in Northern Ireland under the Labour Relations Agency (LRA) / Review of Public Administration (RPA) Independent Appeal stage process.

Inter Alia, the Panel’s conclusions were that the Employer the HSCB (The Board) breached Government Guidelines by way of the Public Service Commissions Guiding Principles (4th and 5th), breached the RPA Code of Practice and broke agreements with NIPSA and the other Health Service Trade Unions.

Compensation was awarded to the appellants by the panel and recommendations were made.
